All ticket requests will be processed in the approximate order in which they are received. The fee for any ticket purchase is not tax deductible in accordance with IRS regulations. No refunds are available and all ticket sales or donations are final.

2.1 Ticket(s). Tickets are $100 each suggested minimum donation. Any single ticket purchase from November 20, 2008 at 9:00 a.m. EST and ends on March 31, 2009 will be valid. Buy (1) ticket for $100 dollars with a Limit of (10) tickets per entrant for this event. KWSO will reject any raffle ticket request if the check or credit card payment is not honored or is returned due to insufficient funds or any other reason. All returned checks are subject to a $25 fee. Money orders are subject to the same rules. No refunds or exchanges. No credit card charge backs, or disputed charges to entrant’s credit card company regarding a valid entry payment, by any entrant, this will void entry and a service fee of $39 will be charged to the entrant’s credit card for this service. Odds of winning are one in 300 eligible entries received. Winner must claim prize with Key West Symphony Orchestra, Inc, sign and deliver an affidavit of eligibility and acceptance of these Official Rules and release of liability to Key West Symphony Orchestra no later than 5:00 p.m. EST thirty (30) calendar days from announcement or first attempt at contact, or the prize will be forfeited and awarded to alternate winner, see section (4). Prizes are not transferable. No substitutions or exchanges (including for cash). Actual prize may vary from photos used in print. No purchase or contribution necessary to tour the Paradise Island Vacation Property. No entrant need be present to win. No purchase or contribution is necessary. Winner determined by random drawing from all eligible entries, to be held at the Westin Resorts and Marina (Sunset Key Island). Key West Symphony Orchestra, Inc will notify winner by telephone or email and U.S. certified mail return receipt on drawing day. To claim prize, winner must follow the instructions contained in their notification. Winner must present two (2) forms of proper ID, one must be a valid State-issued driver’s license or Identification certificate or such other form as will provide proof the entrant’s US residency (e.g., voter registration card, etc.) see section 4 below. KWSO reserves the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered Entry Forms and entries that do not include valid or complete payment. KWSO is not responsible for printing errors in any Raffle-related material, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of KWSO and will not be returned.

3. SELECTION OF WINNERS. Drawing(s) will be conducted by a representative of KWSO as described below. All random drawings will be held under the supervision of an independent accounting firm. Entrants need not be present to win. All tickets will be verified and selected by an independent, third-party accounting firm. Winning tickets will be drawn at the Westin Resorts and Marina (Sunset Key Island), from all eligible ticket requests received. The winner need not be present to win. Winner names, not ticket numbers, will be called. All winners will be called by name and verified by matching the ticket with the information in the KWSO records and the application form. All winners will be notified by telephone, email and certified mail, return receipt requested, information as provided at ticket purchase. Notification by telephone will be made day of drawing. Email and U.S. certified mail, return receipt notification will be made within 24 hours of drawing.
3.1 DRAWINGS: Ticket purchase deadline dates must be met to insure entry in the Drawings. Order of drawings held on October 31, 2008, beginning at 2 p.m. EST are as follows:

First: Westin Resorts and Marina’s Sunset Key Island’s Paradise Vacation with $1,000.00 airline voucher

Second: 37” Panasonic Viera Flat screen Television

Third: $500 Visa/MC Gift Card

3.5 GRAND PRIZE: All entries must be received by deadline to be eligible. The Grand Prize is a 6 Day/7 Night Paradise Island Vacation at Westin Resorts and Marinas Sunset Key Island in a two bedroom garden view cottage. Prize includes complimentary daily breakfast basket delivered to your cottage. Also included in the grand prize is a 1000.00 airline voucher. All other expenses are the responsibility of the guest. A credit card and photo id will be required upon check-in. You must be 25 years of age or older to check in to Sunset Key. Advance reservations required through General Manager’s office by calling 305-294-4000.

No warranties, express or implied, are made or offered by KWSO. The prizes are provided “as is” with no guarantees or warranties from KWSO. Cash prizes will be delivered to Selected Entrant by U.S. registered mail or overnight carrier, in KWSO sole discretion, to the name and address provided on the Entry form. Payment will be done in the form of a gift Card made payable to the name provided on the Entry Form. No substitution or transfer of prizes. Entrant will have one year in calendar days from receipt to use the prize. If any prize winner cannot be located by 5 p.m., thirty (30) calendar days after the announcement or thirty (30) days of prize notification, which ever is greater, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his/her prize and another winner will be selected for such prize. A list of winners may be obtained by writing to KWSO or by visiting "http://www.keywestsymphony.com" www.keywestsymphony.com, list will be posted approximately within 24 hours after final drawing, or by calling 1-(305) 292-1774, 24 hours after the drawing is conducted on October 31, 2008 at 2 PM. Requests in writing must be received or postmarked within seven days of the drawing and include a self addressed, stamped envelope. The IRS has decided that amounts paid for chances in raffles, lotteries or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions.

4. NOTIFICATION. Entrant(s) whose names are drawn at the Drawings will be deemed the winner of the prize for that particular drawing (“Selected Entrant”). Selected Entrants will be notified by phone and/or U.S. Mail using the information provided on the Entry Form or to the operator (“Notification”). If any Selected Entrant cannot be located or fails to return attempts to contact him or her by 5:00 p.m. thirty (30) days after KWSO’s first attempt to contact him or her, such Selected Entrant will be deemed to have forfeited his or her prize and another Selected Entrant will be drawn. Each Selected Entrant will be asked to execute an affidavit of eligibility / liability / publicity release (“Release”). Selected Entrant(s) must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning Ticket, credit card used to purchase ticket. Unless restricted by law, each Selected Entrant will be required to complete and return the Release within thirty (30) days of prize notification. The prize may be forfeited if Selected Entrant(s): (I) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Winner must execute all required documentation to claim their prize, within the (30) days of prize notification. Winners grant permission for the use of their names, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. In the event any selected entrant is found ineligible or forfeits the prize, as described in these official rules, an alternate drawing will be held within five (5) business days after verification the selected entrant is found ineligible, rules of alternate drawing governed by these official rules, and notification will be posted on the website immediately.

5. GENERAL TERMS AND CONDITIONS. By entering the drawing, the entrant agrees to be bound by these Official Rules and the decisions of the Key West Symphony which shall be final. Winners will be required to execute an affidavit of eligibility and a publicity release permitting Key West Symphony to use their name, photograph, likeness and voice for promotional purpose in any media. All winners are required to present proof of identity satisfactory to KWSO sole discretion that matches the name on the winning ticket. Neither Key West Symphony or any Sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, officers, directors, shareholders, members, representatives, or independent contractors or any of its affiliates is responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. Winner agrees to defend, indemnify and hold Key West Symphony, Inc., and/or Sponsors and each of their respective officers, directors, shareholder, employees, agents and affiliates and identities, harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the prize.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE RAFFLE. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
